JourneyQuote.com is a technology platform that brings together national providers and passengers. Please read these terms carefully. By using the JourneyQuote Website and/or the Services, you agree to be bound by these Terms.
1.1. If you book a bus, minibus or coach via this website, you agree to the terms below. If you are booking on behalf of someone else, by accepting a booking you are representing that you have their authority to accept these terms and conditions on their behalf.
- 2.1. In these Terms and Conditions the following expressions shall have the following meanings save where the context otherwise requires:
- 2.1.1. "Agreed Pick-Up Point" the appointed place for You to be picked up by the Transport Provider as set out in the Details.
- 2.1.2. "Agreed Time" the appointed date and time for You to be picked up by the Transport Provider as set out in the Details.
- 2.1.3. "Booking" the booking of transport effected via this Website for undertaking Trips. Bookings can be made for single Trips, return Trips or split Trips.
- 2.1.4. "Transport Provider" the Private Hire Operator, Bus/Minibus or Coach company with whom You place the Booking.
- 2.1.5. "Transport Providers T&C" the terms and conditions of the transport provider which in addition to these Terms govern the Booking and (Trip).
- 2.1.6. "Card" the credit, debit or charge card You use when making the Booking.
- 2.1.7. "Cash" the payment You make for the Fare to the Transport Provider and/or its Driver.
- 2.1.8. "Card Costs" are the charges due to the credit card companies used by You to pay for the Trip
- 2.1.9. "Details" the details which You must provide upon making a Booking including pick-up date and time, pick-up and drop-off addresses and Your Personal Data.
- 2.1.10. "Fare" the fee paid by You for the Quote You accept.
- 2.1.11. "Goods" any goods carried in a vehicle which are booked via this Website.
- 2.1.12. "Trip" the journey You wish to make from the pick-up address to the drop-off address provided by You.
- 2.1.13. "Licensing Authority" any regional or national licensing authority responsible for licensing the operation of minibus or coach companies.
- 2.1.14. "Particular Requirements" any specific requirements You may have relating to disabled facilities or otherwise.
- 2.1.15. "Passenger" any passenger carried in a vehicle which is booked via this Website.
- 2.1.16. "Personal Data" the details which You provide regarding Your physical and email addresses, telephone number and Card details.
- 2.1.17. "Quote" a fixed price that You receive via the Website for the Trip
- 2.1.18. "Terms" these terms and conditions between JourneyQuote and You.
- 2.1.19. "You" means the person who enters Details.
- 2.1.20. "Bus/Coach" is a Private Hire Vehicle made available for pre-booked Trips, in compliance with the requirements of relevant Licensing Authorities.
- 2.1.21. The clause headings and any other headings are inserted for convenience only and shall not affect the construction of these Terms.
- 3.1. In making a Booking via this Website You must provide accurate Details and are responsible for any failure to do so.
- 3.2. JourneyQuote acts as a disclosed booking agent for the Transport Provider, and is not a Transport Provider itself.
- 3.3. You hereby warrant to JourneyQuote that You are at least eighteen years of age and legally able to make the Booking.
- 3.4. JourneyQuote does not guarantee that the Transport Provider will be able to fulfil your requirements. If a Transport Provider cancels your booking for any reason or does not show up for a trip for any reason, JourneyQuote will refund your 10% Fee paid by You at the booking confirmation stage.
- 3.5. Your Details and data relating to Your use of the Website will be recorded by JourneyQuote but Your Personal Data shall not, subject to the provisions of the JourneyQuote Privacy Policy be disclosed to third parties other than the Transport Provider or used for any purpose unrelated to the provision of the services pursuant hereto.
- 3.6. JourneyQuote may send a small file to Your computer when You visit the Website. This "cookie" will enable JourneyQuote to track your behaviour on the website and to identify particular areas of interest so as to enhance Your future visits to the Website. The cookie will not enable JourneyQuote to identify You and JourneyQuote shall not use it otherwise than in relation to this Website. You can set Your computer browser to reject cookies but this may preclude use of certain parts of this website. JourneyQuote may disclose Your Personal Data if compelled to do so by law, or at the request of a law enforcement agency or governmental authority.
- 4.1. When You enter the details of the trip, JourneyQuote will endeavour to provide You with Quotes from Transport Providers that are able to fulfil Your requirement however JourneyQuote shall have no responsibility whatsoever if it is unable to provide You with Quotes for whatever reasons.
- 4.2. It is Your responsibility to ensure that your details are correct. When you accept a quote and pay your 10% booking fee this constitutes an offer. Your Booking is not confirmed until you see the confirmation screen on the Website. You will also receive a confirmation email and details of your booking can be viewed in your dashboard on the website.
- 4.3. In the event, you need to amend or correct a booking you must contact your Transport Provider directly. There may be additional costs incurred depending on the requirement.
- 4.4. Any booking you make will also be subject to the Transport Providers Terms & Conditions, and it is Your responsibility to check and read those Terms & Conditions
- 4.5. JourneyQuote cannot guarantee the ability of the Transport Provider to accommodate any Particular Requirements and in the event that You have such Particular Requirements You should confirm directly with the Transport Provider.
- 4.6. JourneyQuote reserves the right to correct typographical errors in any elements of the information that appears on the Website including pricing mistakes. If, once You are informed of such error, You wish to withdraw Your offer and do not wish to proceed with the purchase, You shall be free to do so and any monies already paid by You will be refunded in full.
- 4.7. When making a booking You pay JourneyQuote 10% of the journey price online by card. The remaining 90% of the fee will be paid by You directly to the Transport Provider either by card or cash. You need to confirm the details of this payment directly with the Transport Provider and you will be subject to their Terms and Conditions.
- 4.8. It is against JourneyQuote.com's policy forPassengers and Transport Providers to communicate offline until after the journey is confirmed. Bookings must be made on JourneyQuote.com and the 10% confirmation fee paid directly to JourneyQuote before the Passenger and Transport Provider arrange the final payment between themselves. If any jobs are confirmed outside of JourneyQuote.com we will have no choice but to exclude the Transport Provider from our platform. Transport Providers and Passengers can message each other through the chat function in their private dashboards on the site.
- 5.1. When making a booking You pay JourneyQuote 10% of the journey price online by card. The remaining 90% of the fee will be paid by You directly to the Transport Provider either by card or cash. You need to confirm the details of this payment directly with the Transport Provider.
- 5.2. When paying by card you agree that JourneyQuote can charge your card 10% of the booking price. JourneyQuote will not store any of your card details.
- 5.3. Once You have confirmed Your Booking on the payment screen, it cannot be cancelled or changed except in accordance with clause 7 of these Terms.
- 5.4. If paying by Card, in the event that Your Card payment is refused by Your Card issuer for whatever reason, JourneyQuote will not be able to confirm Your Booking.
- 5.5. JourneyQuote will provide You with a receipt for Payment by email to the email address you registered with the booking.
- 5.6. Payment will not cover any extra requirements you request, such as child seats. If you do not indicate any additional luggage when booking, resulting in a larger size vehicle being required, then the Transport Provider may charge you extra, which you must pay them directly for. If You wish to give a tip to the Transport Provider driver, You should do so directly at your own discretion.
- 5.7. In the event that You make any deviations from the route that You entered into the Website, You may be subject to additional charges by the Transport Provider in respect thereof and will make such payment directly to the Transport Provider.
- 5.8. JourneyQuote offer no warranties on payments made directly to the Provider.
- 5.9. It is against JourneyQuote.com's policy forPassengers and Transport Providers to communicate offline until after the journey is confirmed. Bookings must be made on JourneyQuote.com and the 10% confirmation fee paid directly to JourneyQuote before the Passenger and Transport Provider arrange the final payment between themselves. If any jobs are confirmed outside of JourneyQuote.com we will have no choice but to exclude the Transport Provider from our platform. Transport Providers and Passengers can message each other through the chat function in their private dashboards on the site.
6.1. Neither JourneyQuote nor the Transport Provider is responsible to You for, or insured in respect of, any damage or loss that may be sustained by the Goods in the course of a Trip and it is Your exclusive responsibility to have such Goods insured in respect of such damage or loss.
- 7.1. Cancellations must be made by you directly to the Transport Provider and you will be subject to their Terms and Conditions.
- 7.2. In the event that the Transport Provider cancels or does not turn up for any reason at the Agreed Pick-Up Point You will be entitled to a full refund of your 10% deposit from JournyQuote along with any Card Costs and JourneyQuote will have no other responsibility or liability of any kind for any losses whatsoever that may be incurred by You as result of the Transport Provider cancelling or failing to turn up for any reason. You will be subject to the Transport Providers terms and conditions outside of this 10%.
- 7.3. In the event that You are not available at the Agreed Pick-Up Point it will be at the Providers discretion to treat Your non-availability as a cancellation. Again you will be subject to the Transport Providers terms and conditions.
- 7.4. In the event that you cancel your Booking for any reason you will not be entitled to a refund from JourneyQuote.
- 7.5. In the event that you wish to cancel a return leg of your journey, you will not be entitled to any refund.
- 7.6. In the event of a booking cancellation or no show by a transport provider, you must contact JourneyQuote within 7 days to issue your refund.
- 8.1. The Transport Provider has warranted to JourneyQuote that it is licenced by the appropriate Licencing Authority(ies) and JourneyQuote have validated the licence and no responsibility of any kind shall attach to JourneyQuote in the event that the Transport Provider is not licenced by the appropriate Licencing Authority(ies)
- 8.2. JourneyQuote shall not be liable for any delays in pick-up or drop-off times or for any failure of the Transport Provider to arrive at all or for any failure of the Transport Provider to provide its services in accordance with Your requirements or expectations.
- 8.3. JourneyQuote shall not in any event be liable (whether in contract or otherwise) for any indirect loss or consequential loss or loss of revenue, howsoever arising, suffered by You in connection with any failure by the Provider or otherwise in connection with these Terms or otherwise and if You consider that You have any claim in respect of any failure by the Provider You agree to make such claim directly against the Provider.
- 8.4. JourneyQuote’s aggregate liability in respect of these Terms and any matter arising out of it (including claims whether made in contract or tort) shall be limited to 500 euro.
- 8.5. Subject as expressly provided in these Terms all warranties, conditions or other terms implied by statute or common law are excluded as far as legally possible. JourneyQuote is not liable, whether in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise in connection with this Agreement (including use of the Online Portal) for any: loss of profit, loss of revenue, loss of business, loss of goodwill or reputation, loss of or corruption or damage to data or loss of anticipated savings, in each case whether direct or indirect; and indirect, special or consequential loss or damage, howsoever arising.
- 8.6. Nothing in this clause shall operate so as to exclude any rights You may have under consumer legislation or limit the Transport Providers liability for death or personal injury arising out of its negligence.
- 8.7. Any estimated trip times and times of arrival presented by JourneyQuote on its Public website or otherwise, are only to be taken as indicative, and are not subject to traffic and/or weather conditions and final route taken by driver. Therefore, You agree that You are responsible for setting an appropriate Agreed Time that allows You sufficient time to reach Your destination to subsequently check-in for a flight, take a train or fulfill any other dependencies You might have.
- 8.8. JourneyQuote may keep you informed if possible (but without being under any legal obligation to do so) of the status of your Booking by sending You emails although JourneyQuote does not guarantee the delivery nor the timing of these email alerts, and shall not in any event be liable (whether in contract or otherwise) for any indirect loss or consequential loss or loss of revenue, howsoever arising from the omission or delay of such email alerts.
- 8.9. Each foregoing sub-clause of this clause shall constitute a separate and severable provision. The provisions of this clause shall continue in effect notwithstanding the termination, completion or any other matter which might otherwise cause these Terms to become ineffective.
- 9.1. The Transport Provider reserves the right within its reasonable discretion to terminate the Trip, if You or Your party's conduct or behaviour is disruptive in any way and/or affects your safety or that of the driver of the vehicle. Neither JourneyQuote nor the Transport Provider accept liability for any extra costs incurred by you/or your party as a result of the Transport Provider doing so.
- 9.2. Passengers are not permitted to take alcoholic drinks onto the vehicles for the purpose of consuming them during the Trip.
- 9.3. The Transport Provider further reserves the right to refuse carriage to any person who is thought to be under the influence of alcohol or drugs.
- 9.4. By using JourneyQuote you agree that you will not use JourneyQuote: for any unlawful purpose; in any way that interrupts, damages, impairs or renders JourneyQuote less efficient; to transfer files that contain viruses, trojans or other harmful programs; to access or attempt to access the accounts of other users or to penetrate or attempt to penetrate any security measures; to disseminate any content which is defamatory, obscene, or may have the effect of being harassing, threatening or abusive to an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability or otherwise; to advertise or promote third party or your own products or services;
- 9.5. By using JourneyQuote you acknowledge that JourneyQuote has limited control over the nature and content of information and chat transmitted or received by you or other users of JourneyQuote. Although JourneyQuote reserves the right to do so, it does not monitor such content in the usual course of business and will not be liable for any such content. - 10.1. The Transport Provider shall not undertake the carriage or delivery of:
- 10.2. money or securities, antiques, precious metals, furs, or jewellery or value, any goods or property (of what so ever nature) of an intrinsic value of more than £50.
- 10.3. any goods or property of a hazardous, dangerous, inflammable, explosive or noxious nature, or are illegal to possess under existing English Law, and/or
- 10.4. any goods or property (of whatsoever nature) which may deteriorate in transit.
- 10.5. the Transport Provider shall have no liability whatsoever for loss or damage, however arising in relation to the clause 10.1 of this agreement.
- 10.6. Without prejudice to the provisions of clause 10.1 the Transport Provider shall not in any event be liable directly or indirectly for:
- 10.7. consequential loss (whether for loss or profit or otherwise) and/or
- 10.8. loss, damage and/or breakage to any fragile items whatsoever whether arising from the acts, omissions or negligence of the Transport Provider and/or its employees and/or agents or arising otherwise howsoever.
- 10.9. Without prejudice to the generality of clauses 10.1 and 10.2 in particular the Transport Provider shall not be liable for any loss and/or damage arising directly or indirectly from:
- 10.10. breakdown, accident, adverse weather conditions
- 10.11. any act or omission on the part of the Passenger/Customer
- 10.12. any clause, act or circumstance beyond the control of the Transport Provider (including, without limitation, any strike, (official or not) lock-out or other form of industrial action or labour dispute, governmental regulations, legal restrictions, embargoes, fire, flood, Act of God, any consequence of riot, war, invasion, act of foreign enemy, hostilities (whether war be declared or not) civil war, acts of terrorism, rebellion, military or usurped power, confiscation, requisition or destruction of or damage to property by or upon the order of or in the name of any Government or public local authority, or other conditions amounting to force majeure).
- 10.13. the provision of clauses 10.1, 10.2, 10.3, 10.4 and 11.1 apply to liability for loss or damage to goods or property and do not apply to liability for death or personal injury.
- 11.1. If You have any complaint in respect of the service provided by the Transport Provider, please contact JourneyQuote by email
- 11.2. If JourneyQuote is then unable to resolve any claim You may have in respect of the service provided by the Transport Provider to the mutual satisfaction of You and the Transport Provider, JourneyQuote shall be entitled to submit such claim to the determination of an independent third party selected by JourneyQuote and You agree to be bound by the decision of such third party.
- 11.3. Should You have a dispute with the Transport Provider, JourneyQuote is not liable for any claims, demands and damages (actual and consequential) of any kind and nature arising out of or in any way connected with such disputes.
- 12.1. Your use of JourneyQuote grants you no rights in relation to our intellectual property rights (including, without limitation, copyright, trade marks, logos, graphics, photographs, animations, videos and text or rights in and to JourneyQuote software, applications and website) or the intellectual property of our retail or advertising partners, other than the non-transferable, personal right to use and receive the JourneyQuote services in accordance with these Terms;
- 12.2. These Terms shall form the entire agreement between the parties and supersede any previous agreement and (save so far as expressly preserved hereby) representations oral or otherwise made by either of the parties. You warrant that You have not relied on any representation made by JourneyQuote in entering into this agreement.
- 12.3. Failure by either party at any time to enforce any right claim or provision of these Terms or arising hereunder shall not be construed as a waiver of such right, claim or provision.
- 12.4. All notices to JourneyQuote shall be given by You in writing to info@journeyquote.com
- 12.5. All notices to You shall be given in writing to the email address You have provided as part of the Details.
- 12.6. These Terms and Your agreement with JourneyQuote shall be governed and construed in accordance with Irish Law. You irrevocably agree for the exclusive benefit of JourneyQuote to submit any dispute hereunder to the jurisdiction of the courts of Ireland but nothing herein shall prevent JourneyQuote from taking proceedings against You in any other court of competent jurisdiction.
13.1 Please read our full Competition Rules page before entering into any JourneyQuote competition. JourneyQuote posts the details of all competitions on our social media pages where the closing date is specified. To enter any JourneyQuote competition you must be: (a) Republic of Ireland resident; and (b) 18 years old or over at the time of entry. No purchases are necessary. Competitions are not open to employees (or members of their immediate families) of JourneyQuote Ltd.
- 14.1 We may wish to transfer our rights or obligations or sub-contract our obligations under these Terms to another legal entity. You agree that we may do so provided that this will not adversely affect the standard of service you receive under these Terms. You may terminate your agreement with us at any time. These Terms are personal to you. You may not transfer your rights or obligations under these Terms to anyone else.
- 14.2 If you breach these Terms and we take no action against you, we will still be entitled to use Our rights and remedies in any other situation where you breach these Terms.
- 14.3 If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply.
- 14.4 These Terms are not intended to give rights to anyone except you and us.
- 14.5 We are constantly looking for ways to improve and expand JourneyQuote. We may amend these Terms from time to time in order to reflect changes to JourneyQuote in which case we will give you reasonable notice by email of any changes to these Terms. You can terminate at any time as set out above.
- 14.6 We will do our best to resolve any disputes over these Terms. If you wish to take court proceedings against us you must do so within the Republic of Ireland.
